Subject: Complaint against Shri. Narendra Modi, Prime Minister of India and the star campaigner of BJP for misuse of state machinery for Election campaign in Haryana and Maharashtra assembly election by telecast/broadcast of program “Mann ki baat” in contravention of the relevant instructions issued by the Hon’ble Commission.

The Election Commission of India was pleased to make an announcement on 12th September 2014, for holding of assembly elections in the state of Haryana and Maharashtra on 15th October 2014. With the announcement being made, the Model code of Conduct and the guidelines for telecast/ broadcast on Doordarshan/All India Radio dated 14th March 2014 became operational.
You kind attention is invited to para 1(b) and (iv) of the Model Code of Conduct, relevant portion of which is as under:
VI. Party in Power
The party in power whether at the Centre or in the State or States concerned, shall ensure that no cause is given for any complaint that it has used its official position for the purposes of its election campaign and in particular :-

(b) Government transport including official air-crafts, vehicles, machinery and personnel shall not be used for furtherance of the interest of the party in power;

Issue of advertisement at the cost of public exchequer in the newspapers and other media and the misuse of official mass media during the election period for partisan coverage of political news and publicity regarding achievements with a view to furthering the prospects of the party in power shall be scrupulously avoided.

The Bhartiya Janta Party, a recognized political party by the E.C.I. led by Shri. Narendra Modi, the Prime Minister of India, is in power at the center. Shri. Modi is not only, the star campaigner of BJP but is the only prime campaigner in the assembly election in these two states. As a matter of fact Shri. Modi is the only face of BJP.
It is provided by the ECI that during the operation of Model Code of Conduct, the telecast/broadcast by political parties shall be as per the slot allotted to them by draw of lots conducted by Prasad Bharti Corporation in consultation with the Commission.
It also provides that “the date for telecast/broadcast will be fixed in consultation with the Commission and the transcript is required to be submitted in advance”.
The introduction and telecast/broadcast of the program “Mann Ki Baat” by Shri. Narendra Modi, Prime Minister of India and the star campaigner of BJP, on 3rd Oct 2014 at 11:00 A.M. is part of the election campaign specially planned and designed for furtherance of the interest of the party in power i.e. BJP by misuse of ‘Government machinery and personnel’. The telecast/broadcast of such a politically motivated program on Doordarshan and All India Radio is an abuse of authority. Such telecast/broadcast are totally prohibited, whereas Shri. Modi has misused the Official machinery despite being in power at the center to extend and further the prospect of BJP in Haryana and Maharashtra in utter disregard and violation of the Model Code of Conduct as also the guidelines on telecast/broadcast.
The Hon’ble commission is aware of its own guidelines date 14th March 2014 and except as per the allotted slot to the BJP Shri. Narendra Modi, Prime Minister of India and star campaigner was and is not authorized to use Doordarshan and All India Radio for Election Campaign. It is not a notified or codified program, as per the rules business of Central Government which Mr. Modi was performing but was only a program to project to attract votes for the BJP. The telecast/broadcast was done in midst of the election campaign by misusing the state machinery when he is also simultaneously campaigning for BJP. Not only this, he has also announced the continuation of such communication via this program (Mann Ki Baat) once or twice a month on Sundays at 11 am.
The modus operandi behind ‘Mann Ki Baat’ is to send a political message in support of BJP in the Elections. He is free to campaign but not in a manner by misuse of state machinery. The tone and tenor of his address is to highlight political agenda.
He even conveniently made announcement of certain schemes and to appease certain class and section of voters has even addressed them, in the name of address to the Nation via program ‘Mann Ki Baat’. He was only acting as the head of the Government at the center and as a star campaigner of BJP to further the interest of political party in the elections.
It is a clear violation of para (i) (b) and (iv) of the Model Code of Conduct in addition to the guidelines on telecast and broadcast on Doordarshan and All India Radio. There has also been misuse of official mass media during the election period for partisan coverage of political news and publicity regarding achievements with a view to furthering the prospects of the party in power.
It is therefore, requested that for such a blatant violation of the model Code of conduct and the Guidelines for telecast/broadcast on Doordarshan and All India Radio immediate stern action may be taken against the BJP and Shri. Narendra Modi and further instructions be issued to them to refrain from conduct of any such program during the operation of the Model code of Conduct. Any further action as may be deemed appropriate any the Hon’ble commission may also be taken.
